Holden Class Action: Faulty Transmissions Spark Legal Battle

A recent class action has been filed against a major car brand, accusing them of producing vehicles with defective transmissions for over a decade. The affected vehicles are said to include models equipped with GM 6L 45, GM 6L 50, or GM 6L 80 transmissions, such as the Commodore VE, Commodore VF, and Colorado.

Alleged Transmission Issues

Maurice Blackburn principal lawyer Kimi Nishimura stated that the class action alleges a design fault in the torque converter and torque converter clutch of the transmission systems in these Holden vehicles. This alleged defect has led to various issues for car owners, including intermittent transmission shudders, excessive vibrations, harsh gear shifts, leakage of automatic transmission fluid, accelerated degradation of transmission components, and increased servicing needs.

Legal Claims Against General Motors

According to Nishimura, the class action asserts that General Motors did not meet the guarantee of acceptable quality under Australian consumer law and engaged in misleading and deceptive conduct. The goal of the lawsuit is to seek compensation for consumers who have suffered losses and damages due to the faulty transmission systems in their vehicles.

Registration and Updates

Nishimura clarified that car owners do not need to register or sign up to be part of the class action, but she encourages them to do so to receive updates on the case’s progress. Even if a vehicle has been sold, written off, or has not shown any problems yet, consumers can still register for the class action.

Keep Informed
